ReTraila Investor Terms & Conditions
Effective Date: August 18, 2026
These Investor Terms & Conditions (“Terms”) govern your use of the ReTraila platform and related services (“ReTraila,” “Platform,” “we,” “us,” or “our”) as a mobile home investor (“Investor,” “you,” or “your”).
By creating an Investor account, accessing the Investor Portal, submitting an offer, or otherwise using ReTraila, you acknowledge that you have read, understood, and agree to these Terms.
If you do not agree to these Terms, you may not use the Investor Portal or submit offers through ReTraila.
1. What ReTraila Does
ReTraila is a technology and transaction-support platform designed to connect mobile home park owners and other authorized property representatives with investors interested in acquiring distressed, vacant, abandoned, or otherwise available mobile homes.
ReTraila may facilitate the exchange of information, investor opportunities, offers, communications, and transaction-related information between participating parties.
Unless expressly stated otherwise in a separate written agreement, ReTraila is not the owner or seller of the mobile home and does not guarantee that any property, transaction, investment, or opportunity will be completed.
ReTraila does not guarantee the condition, title, ownership, value, profitability, marketability, or legal status of any mobile home or transaction opportunity.
2. Investor Eligibility
To participate as an Investor, you represent and agree that:
- You are at least 18 years old and legally capable of entering into binding agreements.
- The information you provide to ReTraila is accurate, current, and complete.
- You have the legal authority and financial ability to pursue the transactions for which you submit offers.
- You will comply with all applicable federal, state, and local laws, rules, regulations, park requirements, and transaction requirements.
- You will not use ReTraila for any fraudulent, unlawful, deceptive, or unauthorized purpose.
ReTraila may request additional information to verify your identity, experience, business, funding capability, or other information relevant to your participation.
ReTraila reserves the right to approve, deny, suspend, or terminate an Investor account at its discretion, subject to applicable law.
3. Investor Profile and Buying Criteria
As an Investor, you may create a profile containing information about your investing experience, geographic preferences, property preferences, purchasing criteria, and other information relevant to your investment activity. You are responsible for keeping your profile accurate and up to date.
You may select filters or buying criteria to help identify opportunities that may be relevant to you. Your selected criteria are intended to assist with opportunity matching and alerts. ReTraila does not guarantee that every opportunity presented to you will satisfy every aspect of your investment criteria.
You are responsible for independently reviewing every opportunity before submitting an offer.
4. Opportunity Alerts
ReTraila may send you notifications, alerts, emails, or other communications regarding mobile homes that may match your selected criteria. Receiving an alert does not constitute an endorsement, representation, warranty, or guarantee by ReTraila regarding the property or transaction. You are responsible for conducting your own due diligence.
5. Property Due Diligence
You acknowledge that mobile homes may have issues involving, among other things:
- Title or ownership
- VIN or serial numbers
- Missing or defective documentation
- Liens, taxes, registration, permits
- Park approval and park rules
- Zoning and local regulations
- Condition, structural issues, environmental conditions
- Utility connections, transportability, foundation requirements
- Existing occupants and lot rent
- Required repairs or improvements
ReTraila does not guarantee that any property listing or information is complete, accurate, current, or free of defects. You are solely responsible for conducting whatever due diligence you consider necessary before submitting an offer or proceeding with a transaction.
6. Offers
Investors may submit offers through the ReTraila Platform in accordance with the available opportunity and offer requirements, subject to any applicable Platform rules.
Unless otherwise stated in writing, submitting an offer does not guarantee acceptance. An offer may be accepted, rejected, countered, or withdrawn in accordance with the applicable transaction terms.
You agree that you will submit offers in good faith and will not knowingly submit false, misleading, or intentionally non-serious offers.
7. Accepted Offers and Park Approval
An accepted investor offer does not necessarily mean that the transaction is complete. Where required, the transaction may remain subject to:
- Seller acceptance
- Mobile home park approval
- Buyer approval
- Verification of ownership and title
- Satisfactory due diligence
- Execution of required purchase documents
- Financing or proof of funds
- Required inspections
- Required permits or governmental approvals
- Satisfactory resolution of liens or title issues
- Any other conditions applicable to the transaction
Final park approval is required before an Investor (and ultimate end-buyer resident) is permitted to purchase, move, renovate, place, or occupy a mobile home within a park (usually only one approval is necessary no matter how many purchases are made in the same park or from the same park owner).
8. ReTraila Success Fee
ReTraila charges participating Investors a 10% Success Fee in connection with qualifying transactions completed through the Platform.
The Success Fee is deducted from the Investor’s total submitted offer amount and is not an additional amount to be paid by the seller or park owner. By submitting an offer, the Investor acknowledges and agrees to the applicable Success Fee.
Success Fee Trigger. If an Investor’s offer is accepted and the Investor receives any required final park management approval, the Success Fee becomes payable in accordance with the transaction and closing terms established by ReTraila. The exact timing of when the Success Fee is considered earned and when payment becomes due will be stated in the applicable transaction documentation.
The Investor agrees not to circumvent, avoid, or attempt to eliminate the Success Fee by completing a transaction directly with a seller, park owner, or other party introduced through ReTraila.
9. No Circumvention
If ReTraila introduces or provides an Investor with access to a mobile home, seller, park owner, property representative, or transaction opportunity, the Investor agrees not to intentionally circumvent ReTraila in order to avoid the applicable Success Fee. This provision applies to transactions involving opportunities first introduced through the ReTraila Platform, subject to the limitations and duration specified in any applicable transaction agreement.
Nothing in this section prevents an Investor from independently pursuing a transaction that was demonstrably known to and being independently pursued by the Investor before ReTraila introduced the opportunity, provided the Investor can reasonably document that prior relationship or knowledge.
10. Transaction Documentation
ReTraila may provide, facilitate, or make available transaction-related forms, communications, or documentation. Unless expressly stated otherwise, ReTraila is not providing legal, tax, accounting, title, insurance, inspection, appraisal, or financial advice. You are responsible for obtaining independent professional advice when appropriate. Any purchase agreement or other transaction document may contain additional terms that control the specific transaction.
11. Closing
The parties to the transaction are responsible for completing the closing process and satisfying all applicable closing requirements. Where applicable, a title company, closing agent, attorney, escrow agent, dealer, or other authorized professional may be used.
ReTraila does not guarantee that a transaction will close. ReTraila is not responsible for delays, failed inspections, title problems, financing problems, park approval issues, seller decisions, buyer decisions, governmental requirements, or other circumstances outside ReTraila’s control.
12. Investor Responsibilities
The Investor is solely responsible for:
- Evaluating each investment opportunity
- Determining the amount of any offer
- Conducting due diligence
- Confirming available funds and obtaining financing if applicable
- Determining renovation and repair costs
- Confirming park rules and requirements
- Confirming title and ownership
- Obtaining required licenses, permits, insurance, and approvals
- Complying with applicable laws
- Completing required purchase and closing documents
- Determining whether a transaction is financially appropriate
13. No Investment or Financial Advice
Information provided through ReTraila is for informational and transaction-support purposes only. ReTraila does not provide individualized investment, financial, legal, tax, accounting, or other professional advice.
Any projected purchase price, repair cost, resale value, rental amount, lot rent, profit estimate, or other financial information should be independently verified by the Investor. Past results or examples do not guarantee future results.
14. Property Information
Property information may be submitted by park owners, sellers, agents, representatives, or other third parties. ReTraila may organize, display, or transmit such information but does not guarantee its accuracy or completeness. Investors should independently verify all material information before making an offer.
15. Investor Communications
By using ReTraila, you agree that ReTraila may contact you regarding:
- Property opportunities
- Offer activity
- Transaction status
- Account activity
- Platform updates
- Important service announcements
- Success Fee information
- Other communications related to your use of ReTraila
You may manage certain marketing communications through your account or applicable unsubscribe mechanisms.
16. Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity conducted through your account. You agree to notify ReTraila promptly if you believe your account has been accessed without authorization. You may not share, sell, transfer, or allow unauthorized individuals to use your Investor account.
17. Prohibited Conduct
Investors may not:
- Submit fraudulent or intentionally misleading information
- Submit offers they do not intend to honor
- Misrepresent financial capability or proof of funds
- Attempt to manipulate or interfere with the Platform
- Scrape or harvest Platform information without authorization
- Use information obtained through ReTraila for unlawful purposes
- Harass or threaten park owners, sellers, residents, or other users
- Circumvent ReTraila’s Success Fee
- Create multiple accounts to evade Platform rules
- Engage in conduct that ReTraila reasonably determines is harmful to the Platform or its users
18. Confidentiality and Use of Information
Information made available through ReTraila may contain confidential or commercially sensitive information. You agree to use such information only for evaluating and pursuing legitimate mobile home investment opportunities.
You may not disclose confidential information to third parties except where reasonably necessary to evaluate, finance, inspect, purchase, renovate, move, or close a transaction, or as otherwise permitted by law.
19. No Guarantee of Opportunities or Results
ReTraila does not guarantee:
- A specific number of opportunities
- A specific number of offers
- Acceptance of any offer
- A specific purchase price
- A specific return on investment
- Profitability
- Successful resale or financing
- Park approval
- Successful closing
- Any particular investment result
20. Platform Availability
ReTraila will make reasonable efforts to maintain the Platform but does not guarantee that the Platform will always be available, uninterrupted, secure, or error-free. ReTraila may modify, suspend, or discontinue portions of the Platform as necessary.
21. Suspension or Termination
ReTraila may suspend or terminate an Investor account for violation of these Terms, suspected fraud, misuse of the Platform, nonpayment of amounts due, circumvention of ReTraila, or other conduct that ReTraila reasonably determines warrants suspension or termination, subject to applicable law.
Termination does not eliminate obligations that arose before termination, including applicable payment or Success Fee obligations.
22. Limitation of Liability
To the maximum extent permitted by applicable law, ReTraila shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to an Investor’s use of the Platform or participation in a transaction.
ReTraila’s total liability arising from use of the Platform shall be limited to the amount actually paid by the Investor to ReTraila during the 12-month period preceding the event giving rise to the claim, except where prohibited by applicable law.
23. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless ReTraila and its owners, officers, employees, contractors, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from:
- Your violation of these Terms
- Your violation of applicable law
- Your fraudulent or negligent conduct
- Your transactions with sellers or park owners
- Your use or misuse of the Platform
- Your violation of the rights of another person or entity
24. Dispute Resolution
Any dispute arising from or relating to these Terms or your use of ReTraila shall be handled in accordance with the dispute-resolution procedures established by ReTraila’s governing law and applicable transaction agreements.
25. Changes to These Terms
ReTraila may update these Terms from time to time. Material changes will be communicated through the Platform, email, or other reasonable notice. Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of the revised Terms, to the extent permitted by law.
26. Electronic Agreement
You agree that electronic acceptance of these Terms, including checking an agreement box, clicking an acceptance button, submitting an offer, or otherwise affirmatively accepting these Terms, constitutes your electronic signature and agreement to be bound by these Terms to the extent permitted by applicable law.
ReTraila may maintain electronic records of your acceptance, including the date, time, account information, IP address, version of the Terms accepted, and transaction associated with your acceptance.
27. Entire Agreement
These Terms, together with any applicable transaction-specific agreements, Success Fee disclosures, Platform policies, and other documents expressly incorporated by reference, constitute the agreement between you and ReTraila regarding your use of the Platform. If a transaction-specific written agreement conflicts with these Terms, the transaction-specific agreement will control with respect to that transaction.
28. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
